2. Definitions

For the purposes of these Terms of Service, the following definitions apply:

  • App or ParensUP: the native mobile family routine organization app provided by DAP DIGITAL LTDA;
  • Legal guardian: a natural person of legal age under the law applicable in their place of residence, with legal authority to represent a child or teenager, including fathers, mothers, tutors, or guardians;
  • Child or teenager: a person under 18 whose profile is created, managed, and supervised by a legal guardian within the app;
  • Account: the legal guardian's primary registration, linked to an email and password;
  • Profile: an individual record linked to a legal guardian, child, or teenager within an Account;
  • Premium: a paid subscription tier that grants access to additional app features;
  • User content: tasks, goals, incentives, rewards, incident records, notes, avatars, and other information entered in the app by the legal guardian.

3. Service description and family model

ParensUP is a mobile app designed to help families organize routines, tasks, goals, incentives, and tracking of children's and teenagers' development in an educational and supervised manner.

By its architecture and functional structure, the app adopts security and privacy principles from inception (privacy by design), not allowing open social interaction between minors, advertising targeted at children or teenagers, nor unrestricted communication features between users.

All creation, editing, supervision, and management of content related to the profiles of children or teenagers is the exclusive responsibility of the authorized legal guardian.

ParensUP is available in the following tiers:

  • Free version: access to essential family routine organization features;
  • ParensUP Premium: access to advanced features through a paid subscription, processed exclusively by authorized third-party platforms such as Google Play and the Apple App Store, where applicable.

4. Eligibility

To create and maintain an account in ParensUP, the user must:

  • Be at least 18 years old or have reached the age of legal majority applicable in their country of residence;
  • Have full legal capacity to enter into contracts under applicable law;
  • Commit to creating and managing profiles only for children or teenagers under their legal representation;
  • Provide truthful, accurate, up-to-date, and complete information during registration and platform use.

Children and teenagers may not create accounts directly in ParensUP. Their profiles are created and managed exclusively by a legal guardian, as described in these Terms and in the Privacy Policy.

Where applicable, data processing and access structure will comply with the relevant legislation, including the Brazilian General Data Protection Law (LGPD), the Digital Statute of Children and Adolescents (Brazilian ECA Digital), the Children’s Online Privacy Protection Act (COPPA), and other rules applicable to the protection of minors.

5. Account and security

The legal guardian is the primary holder of the account and remains fully responsible for all activities carried out within it, including actions performed by profiles linked to the family structure.

The user must maintain the confidentiality of their access credentials, including password and associated information, and is responsible for any activity carried out through their account, except when unauthorized use is proven to result from a security failure attributable to ParensUP.

In case of suspected unauthorized use, credential compromise, or security incident, the legal guardian must take immediate action, including changing the password and notifying official support.

The legal guardian may enable, under their exclusive supervision, individual logins for children or teenagers linked to the family account. These accesses have limited functionality and remain subject to the permissions set by the legal guardian.

When multiple legal guardians are linked to the same family structure, any authorized guardian may manage content, profiles, and records related to the linked minors.

In situations of legal conflict, disagreement between guardians under shared custody, family dispute, or questioning of legal authority, ParensUP may, at its reasonable discretion and upon documentary review, temporarily limit certain registration or operational changes until legal representation is adequately proven.

6. Appropriate use and prohibitions

The user agrees to use ParensUP exclusively for lawful, family, educational, and organizational purposes, in compliance with these Terms and applicable law.

The following are expressly prohibited:

  • Using the app for illegal, fraudulent, abusive, or unauthorized purposes;
  • Accessing, attempting to access, or interfering with accounts, profiles, data, or systems belonging to third parties without authorization;
  • Compromising, harming, overloading, performing unauthorized vulnerability tests on, or interfering with the operation of the app, its servers, or its technological infrastructure;
  • Performing reverse engineering, decompiling, reproducing, modifying, distributing, or creating derivative works of the app, except where expressly permitted by applicable law;
  • Inserting, storing, or transmitting offensive, discriminatory, abusive, sexually explicit, violent, or inappropriate content for children or teenagers;
  • Using the app for abusive surveillance practices, coercive control, or any form of use incompatible with the best interest of children or teenagers;
  • Commercializing, sublicensing, reselling, improperly sharing, or transferring access to the app or to the Premium subscription without express authorization from DAP DIGITAL LTDA.

Failure to comply with these provisions may result in suspension, limitation, or termination of the account, without prejudice to applicable legal measures.

7. User content

The user retains title and ownership over all user content entered in ParensUP, including tasks, goals, incentives, rewards, incident records, notes, avatars, and other information added to the account.

To enable the operation of the service, the user grants DAP DIGITAL LTDA a non-exclusive, worldwide, royalty-free license, revocable upon termination of the contractual relationship, limited to the purpose of hosting, storing, processing, technically reproducing, syncing, transmitting, and backing up such content, exclusively for operational purposes related to the provision of the contracted services, subject to residual processing necessary to comply with legal obligations, the retention windows described in the Privacy Policy, or the defense of rights in administrative, judicial, or arbitral proceedings.

This license does not authorize independent commercial use, advertising, content commercialization, public display, or any economic exploitation of the user content beyond the regular operation of ParensUP.

ParensUP does not commercialize, sell, or use user content for targeted advertising.

The user declares having legal authority, consent, and legitimacy to enter, manage, and administer the data provided, especially when related to children or teenagers linked to the account.

ParensUP may provide free-text fields for personalized descriptions and records. The legal guardian acknowledges being exclusively responsible for the information entered in these fields and undertakes to avoid recording sensitive, excessive, or unnecessary data not pertinent to the app's organizational purpose.

8. Platform intellectual property

All rights related to ParensUP, including software, source code, architecture, features, design, interface, trademarks, logos, visual identity, texts, graphics, audiovisual elements, databases, and other components of the platform, belong exclusively to DAP DIGITAL LTDA or its licensors and are protected by applicable intellectual property, copyright, industrial property law, and international treaties.

Any reproduction, distribution, modification, reverse engineering, commercialization, sublicensing, public display, or unauthorized exploitation of any element of the platform is prohibited, except with express written authorization from DAP DIGITAL LTDA or where permitted by mandatory legal provision.

9. ParensUP Premium

  • Symbolic systems of incentives, points, or symbolic money;
  • Advanced goals, targets, and personalizations;
  • Additional parental approvals;
  • Detailed reports and analytical resources;
  • Additional features that may be modified, expanded, or discontinued from time to time.

Premium resources may vary depending on technical availability, geographic region, platform, and service updates.

Prices, currencies, commercial conditions, and free trial periods, when applicable, are displayed in the app interface before contracting and processed by authorized distribution platforms (Google Play and Apple App Store).

10. Billing, cancellation, and refunds

Premium subscriptions are processed exclusively by authorized third-party platforms, such as Google Play and the Apple App Store, depending on the platform used.

DAP DIGITAL LTDA does not process payments directly, does not store complete payment information, and has no direct control over charges, refunds, payment methods, or financial policies applied by those platforms.

Relevant commercial information, including prices, renewal, cancellation, promotional periods, and billing conditions, is displayed to the user by the respective store before contracting.

Automatic renewal, cancellation, and subscription management are governed by the policies of the corresponding store. After cancellation, Premium access remains available until the end of the period already paid for.

Any legal rights of withdrawal, refund, or contestation provided in applicable law may be exercised with the platform responsible for the transaction or, where applicable, directly with DAP DIGITAL LTDA.

DAP DIGITAL LTDA may provide technical support related to the operation of the app, but has no authority to approve, deny, or process financial refunds carried out by third parties.

11. Privacy and personal data

The processing of personal data carried out by ParensUP is governed by the Privacy Policy, which is part of these Terms of Service for all legal purposes.

ParensUP seeks to operate in compliance with applicable data protection laws, including the LGPD, the Digital Statute of Children and Adolescents (Brazilian ECA Digital), the COPPA, the GDPR, the CCPA/CPRA, and other pertinent rules, as applicable to the user's jurisdiction.

We recommend reading the Privacy Policy in full for a detailed understanding of collection, use, retention, sharing, and exercise of rights related to personal data.

For requests related to privacy and data protection, contact the Data Protection Officer (DPO) as indicated in the Privacy Policy, or directly through the official channel: privacy@parensup.com.

12. Suspension and termination

The user may stop using ParensUP at any time. To completely delete the account and the data linked to it, go to Settings > Legal and privacy > Delete account within the app. After confirmation, we begin the deletion process within the timeframes described in the Privacy Policy.

DAP DIGITAL LTDA may, at its reasonable discretion and observing applicable legal requirements, suspend, limit, or terminate accounts in cases of:

  • Violation of these Terms;
  • Reasonable suspicion of fraud;
  • Abusive or unsafe use of the platform;
  • Legal or regulatory requirement;
  • Risk to the security, integrity, or operation of the service.

In case of suspension or termination, certain provisions of these Terms will remain in effect to the extent necessary, including rules on intellectual property, liability, legal limitations, data protection, and dispute resolution.

13. Limitation of liability

ParensUP is a tool that supports family routine organization, provided as is, with the resources available at the time of use.

The app does not replace professional guidance in the areas of education, psychology, pediatrics, or child development. Educational, behavioral, or health-related decisions are the sole responsibility of the legal guardian.

Without prejudice to the unwaivable responsibilities provided in the Brazilian Consumer Defense Code and other applicable law, DAP DIGITAL LTDA is not liable for indirect damages, lost profits, loss of opportunity, or use interruptions arising from:

  • Failures, unavailability, or third-party attacks against infrastructure, observed reasonable mitigation efforts;
  • Use of the app in breach of these Terms or of its purpose;
  • Content entered by the legal guardian themselves.

This clause does not exclude or limit responsibilities arising from willful misconduct, gross negligence, or those expressly provided in applicable law.

14. Indemnification

You agree to indemnify and hold DAP DIGITAL LTDA, its partners, officers, and employees harmless from any claims, losses, damages, or expenses, including reasonable legal fees, arising from:

  • Violation of these Terms;
  • Illegal, abusive, or fraudulent use of the app;
  • User content that infringes third-party rights.

This clause does not apply to cases of willful misconduct, gross negligence, or breach by DAP DIGITAL LTDA of obligations provided in these Terms, in the Privacy Policy, or in applicable law.

15. Changes to these Terms

These Terms may be updated periodically to reflect legal, regulatory, operational, or feature-related changes to ParensUP.

Material changes will be communicated at least 30 days in advance of their entry into force, through the app, by email, or through other appropriate channels. The date of the latest update will always be indicated at the beginning of this document.

If you do not agree with the updated version, you may stop using the app and cancel your subscription at no additional cost.

Continued use of ParensUP after the new version takes effect will be interpreted as acceptance of the revised Terms, in accordance with applicable law.

16. Dispute resolution and venue

In case of disagreements, we recommend reaching out first to privacy@parensup.com as an attempt at amicable resolution.

Brazilian consumers benefit from the right, under art. 101, item I, of the Brazilian Consumer Defense Code, to bring actions before the venue of their domicile.

These Terms are governed by the laws of the Federative Republic of Brazil, including the Consumer Defense Code, the General Data Protection Law (LGPD), and the Brazilian Internet Civil Framework, with applicable international consumer-protection and data-protection rules applying, where pertinent, to users located in other jurisdictions.

17. General provisions

If any provision of these Terms is deemed invalid, illegal, or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.

The user may not assign or transfer rights and obligations arising from these Terms without the prior written consent of DAP DIGITAL LTDA. DAP DIGITAL LTDA may assign these Terms in case of merger, acquisition, corporate reorganization, or asset sale, with prior notice.

Any tolerance by DAP DIGITAL LTDA in respect of a breach of any obligation provided in these Terms does not constitute waiver, novation, or contractual amendment, and the rights may be exercised at any time.

DAP DIGITAL LTDA will not be liable for failures, delays, or interruptions caused by force majeure or fortuitous events, including natural disasters, government actions, third-party infrastructure failures, or cyberattacks beyond its reasonable control.

These Terms, together with the Privacy Policy, constitute the entire agreement between the user and DAP DIGITAL LTDA, prevailing over any prior understandings, communications, or agreements related to the use of ParensUP.
